Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Webium Mail platform, related websites, applications, interfaces, APIs, communications, and services (collectively, the “Services”) provided by Webium LLC, Seattle, WA, USA (“Webium,” “we,” “us,” or “our”).

By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility and Authority

You represent and warrant that you are legally able to enter into these Terms and that you will use the Services only in compliance with applicable law. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of the Services

Webium Mail is an email and communications platform that may use a mobile phone number as a core account identifier and/or as part of the user’s email address. The Services may include email sending, receiving, storage, login verification by text message, security notifications, support messaging, and related account features.

3. Account Registration and Security

You must provide accurate and current information when registering for the Services. You are responsible for safeguarding your device, account credentials, and access to your mobile phone number. You are responsible for all activities that occur under your account, whether or not authorized by you, unless prohibited by law.

4. Important Messaging Disclosure

Webium may send transactional or service-related text messages, including login codes, authentication messages, security alerts, and account notices. If you separately opt in, Webium may also send additional non-essential account-related or promotional text messages where permitted by law.

5. Consent to Receive SMS Messages

By providing your mobile phone number and requesting text-enabled features, you authorize Webium and its messaging service providers to send you SMS or similar messages related to your account and use of the Services. Where required by law or carrier rules, we will rely on your express consent before sending non-essential or promotional messages.

You agree that consent must be provided directly by you, the end user. You may not provide a number that belongs to another person unless you are lawfully authorized to do so. You agree to keep your mobile number current and to update your account if your number changes.

You may use Webium Mail only for lawful, legitimate, and permission-based communications. You may not use the Services to:

If Webium enables any feature allowing you to cause text messages to be sent, you may use that feature only in compliance with these Terms, applicable law, carrier rules, and third-party provider policies. You must obtain appropriate consent before sending any non-essential or promotional text message. You must honor opt-out requests promptly.

8. Opt-In, Opt-Out, and Help Requirements

For text messaging programs, you must maintain auditable proof of consent where required. You must not send messages to recipients who have opted out, withdrawn consent, or otherwise indicated that they do not wish to receive messages. Standard opt-out words such as STOP, END, CANCEL, UNSUBSCRIBE, and similar equivalents must be honored where applicable. Help requests should receive appropriate support instructions.

9. Prohibition on Selling or Sharing Opt-In Data

You may not sell, rent, transfer, or share mobile opt-in data, consent records, or phone numbers for another party’s marketing purposes. Any use of recipient data must comply with the Webium privacy policy and applicable law.

10. Country-Specific and Carrier-Specific Rules

Messaging laws and carrier rules vary by country and by message type. Some jurisdictions impose restrictions on sender IDs, delivery windows, political content, financial promotions, marketing to minors, or mandatory disclosures. You are solely responsible for ensuring that each message you send is lawful in the destination jurisdiction and compliant with applicable carrier, aggregator, and platform rules.

11. Gmail and Major Mailbox Provider Compliance

To preserve deliverability and platform integrity, you agree to follow generally accepted sender standards and the technical and operational rules expected by major mailbox providers, including Gmail. These include, where applicable, proper sender authentication, valid headers, honest subject lines, lawful unsubscribe practices for marketing messages, reasonable complaint and spam rates, and transmission over secure connections. Repeated abuse complaints, high bounce rates, spam complaints, spoofing, or misleading content may lead to suspension or termination.

12. Monitoring, Filtering, and Enforcement

We may monitor, log, filter, review, preserve, or disclose account information, message metadata, IP addresses, routing data, and, where reasonably necessary, message content for security, anti-spam, anti-fraud, abuse prevention, troubleshooting, legal compliance, and enforcement purposes. We may block, quarantine, rate-limit, reject, or remove content or traffic that appears to violate these Terms or third-party requirements.

13. Suspension and Termination

We may suspend, restrict, or terminate access to the Services immediately, with or without notice, if we believe you have violated these Terms, created legal or security risk, harmed users, triggered provider complaints, or jeopardized Webium’s relationships with messaging vendors, carriers, or mailbox providers.

14. Third-Party Providers

The Services may rely on third-party service providers, including cloud vendors, telecom carriers, SMS aggregators, authentication providers, and mailbox/network operators. Your use of Webium may therefore be indirectly subject to third-party rules, platform restrictions, delivery limitations, and regional compliance requirements beyond Webium’s control.

15. User Content

You retain rights you may have in your content, subject to the rights necessary for us to provide the Services. You grant Webium a non-exclusive, worldwide, limited license to host, process, transmit, store, reproduce, and display your content solely as needed to operate, secure, improve, and provide the Services and to comply with law.

16. Privacy

Your use of the Services is also governed by the Webium Mail Privacy Policy. By using the Services, you acknowledge that Webium may collect and process account data, mobile phone numbers, IP addresses, logs, message metadata, and other information described there.

17. No Unlawful or Abusive Use

You may not use the Services in any manner that is unlawful, defamatory, abusive, invasive of privacy, infringing, harmful, discriminatory, deceptive, or otherwise objectionable, or that encourages any criminal conduct, civil liability, or regulatory breach.

18. Disclaimers

The Services are provided on an “as is” and “as available” basis, to the maximum extent permitted by law. Webium does not guarantee uninterrupted availability, successful delivery of every email or text message, universal compatibility, or error-free operation. Carrier filtering, mailbox-provider filtering, routing failures, device limitations, regional restrictions, and other external factors may affect delivery.

19. Limitation of Liability

To the maximum extent permitted by law, Webium shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunities, or reputation arising out of or related to the Services or these Terms.

20. Indemnification

You agree to defend, indemnify, and hold harmless Webium, its affiliates, officers, members, employees, contractors, and agents from and against claims, liabilities, damages, losses, judgments, fines, costs, and expenses arising out of or related to your use of the Services, your content, your messaging campaigns, your violation of these Terms, or your violation of law or third-party rights.

21. Changes to the Services or the Terms

We may modify, suspend, or discontinue any part of the Services, and we may update these Terms from time to time. Updated Terms will be posted with a new effective date. Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.

22. Governing Law and Venue

Unless otherwise required by applicable law, these Terms shall be governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services shall be brought in the appropriate courts located in or serving Seattle, Washington, except where mandatory law provides otherwise.
